You’ve probably seen the headlines: “The NFA is dead.” “No more Form 4s.” “Suppressors are deregulated.” Slow down. The federal court ruling in Silencer Shop Foundation v. ATF is a major win, but it did not erase the National Fi****ms Act for everyone, everywhere.

What the Texas judge actually ruled is that the NFA’s registration and approval scheme cannot be enforced against specific plaintiffs, their members, customers, and certain covered state entities when it comes to suppressors, SBRs, SBSs, and some AOWs. The reasoning is simple: Congress reduced the relevant NFA tax to $0, and the court found the registration system, originally justified as a way to collect that tax, could no longer stand on that taxing-power foundation.

That means who you are, where you live, and who you buy from matters. Many gun owners are still subject to the normal NFA process. State laws still apply. Machine guns and other devices remain under the NFA. And the ruling does not magically make every suppressor transfer a same-day sale at every dealer.
