How does a background check work, and is it GDPR-compliant?

Here’s the quick version:
Consent comes first. The candidate understands the process and agrees to every area being checked.
The employer picks the scope: education, employment, references, certifications, criminal records and more.
Every claim is compared with what can be verified, and the source is noted.
Within 5 to 10 days, the employer gets a report flagging each finding as confirmed, minor mismatch or major mismatch.

Why bother? In a 2020 Checkster survey, 78% of job seekers said they’d misrepresented themselves on an application, or had thought about it. The most common: claiming skills they rarely use, and stretching employment dates.

At Mindit, a dedicated case handler is on every case, so candidates get answers fast and nothing stalls.

A background check isn’t about digging into a candidate’s entire life. In fact, it’s often the opposite.

The goal is simple: verify what’s relevant to the role and identify genuine risks. Nothing more.
So what can actually be checked?
🔻 Employment and education history
🔻 Professional licences
🔻 References
🔻 Criminal records, where relevant and legally justified

And what’s off-limits?
❌ Protected characteristics such as religion, ethnicity, age or health
❌ Medical information
❌ Legally spent convictions

For HR teams, relevance matters. Collecting information you don’t need can create unnecessary risk.
For candidates, this is actually reassuring: a proper background check should be focused, proportionate and GDPR-compliant.

At Mindit Consulting, we help companies verify employment, education, criminal records and professional credentials across Romania, the EU and the UK, with consent and compliance built into the process.

Does a background check make hiring fairer or riskier? It depends on how you design the process.

64.2% of employees admit to lying on their CV, so checking makes sense. But automatically rejecting anyone with a record can filter out good candidates and expose the company to legal risk.
The better approach is to look at the offence, how long ago it happened and whether it's relevant to the role.

Think you know what really happens during a background check?

There’s a lot of confusion around background screening and quite a few myths that just aren’t true.

🔻 “It’s basically just a criminal record check.”
🔻 “They can dig into my personal life.”
🔻 “If something comes back negative, I’m automatically out.”
🔻 “They can contact my current employer without telling me.”
🔻 “Only big corporations do background checks.”

Here’s the reality: a properly conducted background check is a structured, fair process focused on verifying information that actually matters for the role.

Depending on the position and local rules, it might include checks on employment history, education, professional certifications, sanctions, or other relevant records.

Good screening is about evidence and context, not assumptions.

We’ve unpacked the most common background check myths in our latest article.

Hiring across countries makes background screening trickier. The GDPR framework is shared, but the rules on specific checks differ across Romania, the UK and the EU.

Our new article and podcast cover the areas that cause the most confusion:

🔻Consent isn't the whole legal picture. A signed form doesn't automatically make a check lawful.
🔻Criminal record checks differ by country. The UK runs through DBS; Romania and the EU apply much stricter conditions under GDPR and national law.
🔻Screening should match the role. Keep the checks relevant and proportionate.

If you hire across borders, these details matter, both for compliance and for a screening process you can defend in an audit.

The questions we hear most from employers about background screening usually start the same way: "Are we actually allowed to..."

Are we allowed to ask for a criminal record? Check social media? Verify a degree? Run the same checks on everyone?

The tricky part is that the answers change depending on whether you're hiring in Romania, the UK, or the US.
So we answered the most common ones in a straightforward FAQ, no legal jargon, just what employers need to know. Link in the comments.

You've made the offer. The candidate said yes. And then the background check flips to "pending," and suddenly the start date you promised starts to wobble.
If that sounds familiar, you're not alone. "How long does a background check take?" is one of the most common questions in hiring, and the honest answer is: it depends on which check.

Here's the short version:
Most single checks clear in 1 to 3 working days. A full screening package usually runs somewhere between 2 and 10, depending on what's in it and where your candidate has lived and worked. The slow part is almost always the verifications, employment, education, and references, because those wait on someone else to reply.

A few things that surprise people:
🔻 In Romania, a criminal record certificate is often issued same-day for citizens, but an EU national's check can take up to 30 days through the ECRIS system.
🔻 In the UK, enhanced DBS checks are currently averaging around 22 days thanks to police-review backlogs.
🔻 A single typo in a candidate's name or ID number can quietly add days.

The good news? Most delays are predictable, which means most are preventable. We put together a full guide on what drives turnaround times and how to keep a check moving, without cutting corners on compliance.
