A VERY Late September & October Frag

LEGISLATIVE/JUDICIAL NEWS:
The cases Novotny v. Moore and Kipke v. Moore have been consolidated into one and are currently pending in the Federal District Court in Baltimore. These cases challenge the "sensitive spaces" rule and the Handgun Qualification License requirements. What's worse, the case has not been assigned to a judge's docket.

At the federal level, cases can be heard "en banc," a French term literally meaning "on the bench." This term is typically used in an appellate setting or when there is an issue of greater significance. Given that this case has not been assigned to a docket or designated as en banc, I am cynical about the outcome.
When a case is heard en banc, a panel of at least three judges weighs in on the ruling, which is determined by a majority vote. The composition of the Maryland Federal District Court, where this case is being heard, consists of a mix of moderate to liberal jurists.

LEGISLATIVE/JUDICIAL NEWS:
Big Beautiful Bill and the NFA = SCOTUS Challenges!
With the enactment of the Big Beautiful Bill, the National Fi****ms Act (NFA) is now facing a comprehensive legal challenge. Several non-profit organizations, including the Fi****ms Policy Coalition and the Second Amendment Foundation, have filed lawsuits contesting the constitutionality of the NFA. If the Supreme Court were to apply the same jurisprudential reasoning it used in evaluating the Affordable Care Act (ACA), the NFA could be subject to judicial invalidation, given that its primary justification—like the ACA—rests on the federal government's taxing authority.
However, the current composition of the Supreme Court introduces a degree of unpredictability. Unless the Court fully embraces an originalist framework—an outcome that remains improbable—judicial opinions will likely continue to reflect a degree of inconsistency, resulting in a landscape of quasi-constitutionality.

Big Beautiful Bill and the NFA = SWEEPING CHANGES!

As many of you know, the "BBB" was passed and signed by Donald Trump last week with major implications to the NFA. In January 2026, you will be able to purchase a suppressor, short-barreled rifle, or short-barreled shotgun without paying the cost-prohibitive $200 tax stamp fee. The bill stopped short at automatic weaponry, you must still be fingerprinted and an application sent to the NFA branch of the BATF.

Implications: If you wish to get an NFA item (minus automatic weapons, those still maintain the $200 tax), I humbly suggest you purchase it soon and leave it in the safe at the shop. I submit that you will most likely be a victim of scarcity as soon as the restrictions are lifted in January, you will not be able to find one, much like the ammo crunch of COVID.

The demand has risen for renewal classes, and they are filling. Register as soon as practical as they fill almost as fast as I post the classes. May booked at the beginning of April. With current scheduling obligations, I am only able to offer two, perhaps three classes per month. Below are the current scheduled dates that I have:

YUGE! This is a good run down of the changes to the tax stamp fees and what is actually in the BBB in relation to the NFA.

In 2025, H.R.1 passed with $0 tax stamps for suppressors, SBRs, SBSs, and AOWs starting January 1, 2026. Full deregulation was blocked, but legal challenges may follow. See what this means for gun owners.

Well, it lasted longer than I expected; however, as of now, the NFA reversals many of us were hoping for are dead. As of now, the tax stamp and regulation remains.

Trump's "big, beautiful bill" loses fi****ms deregulation provision that would have eliminated $200 tax and ATF registration for short-barrel rifles, shotguns and suppressors.

Here's the latest, Eliminating Suppressors from the NFA has passed the House of Representatives and headed to the Senate. It's still possible for Short Barrel Rifles to be included as well!
