Why Issue 2 Strengthens Arkansas Article 2, § 5
Arkansas Article 2, § 5 protects the right to keep and bear arms—but its current wording leaves room for government restrictions and gives courts room to determine how strongly that right should be protected.
The current Constitution does not expressly state that:
The right is natural;
The right is fundamental;
The right is individual;
The right “shall not be infringed”; or
Ammunition, firearm components, and firearm accessories are protected as part of the right.
Issue 2 would put those protections directly into the Arkansas Constitution.
That matters because constitutional language matters. Rather than simply saying Arkansans have a right to keep and bear arms, Issue 2 would expressly identify that right as natural, fundamental, and individual, declare that it shall not be infringed, and provide broader protection for the things necessary to exercise that right.
In simple terms:
Current Article 2, § 5 says you have the right.
Issue 2 says what that right is and makes the constitutional protection much harder for government to get around.

Issue 2 could significantly benefit Arkansas arms and firearm-component manufacturers. By recognizing the right to keep and bear arms as a natural, fundamental, and individual right and expressly protecting fi****ms, ammunition, components, and accessories, it would give manufacturers stronger constitutional protections against restrictive state laws.
It could also reduce legal uncertainty and litigation costs, make Arkansas more attractive to firearm-related businesses, and provide greater protection for the entire firearm manufacturing supply chain.

Issue 2 does not replace “shall not be infringed—it strengthens and clarifies it. It retains the explicit command that the right shall not be infringed while adding that the right is natural, fundamental, and individual, and expressly protecting fi****ms, ammunition, firearm components, and accessories. It provides more constitutional detail for courts to apply when determining whether government action violates the right. The purpose is not to weaken or rewrite “shall not be infringed,” but to give that protection greater constitutional substance and clarity.”
