If you're a New Jersey gun owner, this is one to keep an eye on.

Back in March 2026, the D.C. Court of Appeals issued a ruling in Benson v. United States that struck down Washington D.C.'s ban on firearm magazines holding more than 10 rounds. The court found that those magazines are in "common and ubiquitous use" across the country - numbering in the hundreds of millions - and therefore protected under the Second Amendment.

Here's where it gets interesting for us in Jersey: New Jersey has had its own 10-round magazine limit on the books since 2018. That law is currently being challenged in the U.S. Court of Appeals for the Third Circuit , which covers New Jersey, and the Benson ruling was starting to put real pressure on it.

NJ officials actually filed a letter to the Third Circuit trying to limit the influence of the D.C. decision.

But then in a surprising plot twist - the full D.C. Court of Appeals agreed to rehear the Benson case in April 2026, vacating the original ruling in the process. So that March decision is no longer technically in effect while the full court reconsiders it.

What does that mean for New Jersey right now? NJ's 10-round limit is still fully in force and will be until a court says otherwise. The Third Circuit still has its own NJ-specific cases pending, and those are moving forward regardless of what happens in D.C.

Bottom line: the legal landscape around magazine limits is shifting fast. Whether you support these laws or oppose them, it's worth paying attention — because the outcome of these cases could change what's legal to own in New Jersey.

What are your thoughts?
