4473 Suppressors!

We are now processing suppressors with a 4473 with some conditions. If any of these 3 items apply to you, then we can process an over-the-counter suppressor to you.

You must be 21+ to purchase a suppressor.

1. Order the suppressor from Silencer Shop and use us as the transfer dealer. When it arrives, come in for the 4473 and background.
-or-
2. You are an active member of Gun Owners of America (GOA) and have a valid member number.
-or-
3. Purchase any SilencerCo suppressor.

If any of these apply, then you can come purchase a suppressor and walk out with it after you complete the 4473 AND NICS Background check. (Sorry LTC holders, at this time all suppressor transfers are getting the NICS background check. Feel free to use your valid LTC as ID for the transfer, but we are still running the background)

If you want to keep your suppressors in your trust, or you would just feel better processing your suppressor with the Form 4, they are only taking a few days for approval.

NFA - SUPPRESSORS - Now, What's the deal?

We are in a 24 hour holding pattern until we receive guidance from our assigned ATF office. We even put a call in to the President, but the call got dropped when they transferred it to the catering truck.

In all seriousness, we are still selling suppressors. In a best case scenario, we get guidance from the ATF today and start transferring suppressors over the counter (with an approved 4473 background) on Friday. This would still put the suppressor in your hands by the weekend if everything goes as planned.

If you want to secure your suppressor today, you can purchase on our website, in the store, or call us and we will take your order over the phone. We will hold the suppressor until we get confirmation from the ATF of the process, and then transfer accordingly.

Why are you not transferring suppressors today?

Because we have questions. As we read it, only those involved in that lawsuit are affected. If we got a suppressor from a source that was not involved in the suit, it is possible that suppressor still holds the form 4 requirements (pretty dumb huh?).

So far, the ATF has kept their mouth shut and have not given us any guidance on this matter. Once they do, hopefully today, we will post it here and proceed accordingly.

SUPPRESSOR DEADLINE TODAY! What does that mean???

Today is the 7th day after the NFA Registration requirements for Silencers, SBR and SBS was struck down by US District Court. More importantly, it is the Deadline for the ATF/DOJ to respond to the action of the court.

Nearly 50 members of Congress signed a letter yesterday (Aug 11) addressed to A.G. Todd Blanche urging the DOJ to NOT respond to the Court's ruling. They also request that the DOJ should "immediately apply the court's ruling nationwide and set it in regulation through rulemaking", meaning that the ruling would apply to all people nationwide, and not a select few who were involved with the lawsuit, Silencer Shop Foundation v. Should the DOJ not respond to the action of the court, Starting on on August 13, 2026, Suppressors, SBR & SBS would be processed with a form-4473 just like a standard fi***rm, without any delays or extra background checks or registration (fingerprints, wait times, etc). This means, in Texas, you can walk in, pick out your suppressor, run your background and take the suppressor home the same day (with 4473 background approval).

Native Outdoors is on the short list with the ATF to be informed of any guidance they will be providing to FFL dealers to make sure we abide by the law, today, tomorrow and in the future.

What's Next? More on the NFA Ruling making suppressor registration Unconstitutional...

If everything holds, suppressors will be treated like a fi***rm and will require a 4473 and NICS background check.

- Why the Form 4473 Still Applies Under Current Law -

Even if the NFA registration scheme (Form 4, tax stamp, central federal registry, fingerprinting, and wait times) is completely eliminated, over-the-counter transfers at a gun shop would still default to a standard Form 4473 and NICS background check.

This is because of how federal law defines the word "fi***rm":

Under 18 U.S.C. § 921(a)(3)(C) of the Gun Control Act of 1968, Congress explicitly defined "any fi***rm muffler or fi***rm silencer" as a standalone fi***rm—not an accessory.

Because the GCA legally treats a suppressor like a handgun or r***e, any commercial transfer from a Federal Fi****ms Licensee (FFL) legally requires a Form 4473 and instant NICS background check.

- What It Would Take for OTC Sales with No Paperwork -

For suppressors to be sold off the shelf like a scope, bipod, or replacement barrel without any Form 4473 or NICS check, one of two things would need to happen:

Congressional Action: Congress passes legislation that explicitly amends 18 U.S.C. § 921 to strike silencers from the statutory definition of a "fi***rm".

Further Judicial Challenges: Federal courts strike down the GCA's definition of suppressors as "fi***rms" under the Second Amendment, ruling that regulating non-lethal acoustic accessories as fi***rms fails the constitutional historical tradition test under Bruen.

Until that statutory definition changes, a Form 4473 remains the minimum federal baseline for an FFL sale with suppressors being included.

Before you come running down here to BUY your suppressor "over-the-counter" STOP!

You might have heard that the U.S. District Court for the Northern District of Texas has held that the National Fi****ms Act's registration and approval requirements for suppressors, short barreled r***es and short barreled sh****ns exceeds Congress's constitutional authority since the NFA's Tax Stamp fee was eliminated.

What does that mean for you and me? Nothing, at least for 7 days. The govt. has the opportunity to seek relief from the 5th Circuit Court of Appeals, and until the 7 days are up, everything stays the same.

Feel free to come get a suppressor today, there is a chance that it will be approved with the current process before this goes into effect.
