Bicycle and e-bike injuries are skyrocketing in Montgomery. AN ORDINANCE OF THE CITY OF MONTGOMERY, ALABAMA, AMENDING CHAPTER 27, ARTICLE V OF THE MONTGOMERY MUNICIPAL CODE TO ADD HELMET USE
WHEREAS, pursuant to Title 11, Chapter 45, Section 11-45-1 of the Code of Alabama, municipalities are empowered to adopt ordinances and resolutions “to provide for the safety, preserve the health, promote the prosperity, and improve the morals, order, comfort, and convenience of the inhabitants of the municipality”; and
WHEREAS, under the Brad Hudson–Alabama Bicycle Safety Act of 1995, codified in Title 32, Chapter 5A, Article 13 of the Code of Alabama, the State regulates the use of protective bicycle helmets when riding in public; and
WHEREAS, the City of Montgomery seeks to reinforce these State safety requirements by adopting a local ordinance mandating the use of bicycle helmets by all cyclists in public within City limits; and
WHEREAS, the City Council finds that local enforcement of helmet use will enhance public safety and reduce serious injuries, consistent with State law;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA:
Section 1. Amendment to Code.
Chapter 27, Article V of the Montgomery Municipal Code is hereby amended by adding Section 27-308, to read as follows:
Sec. 27-308. Helmet Use.
Any person operating or riding as a passenger on a bicycle or motor-driven cycle shall wear a properly fitted and fastened helmet.
Section 2. Codification.
This ordinance shall be codified in Chapter 27, Article V of the Montgomery Municipal Code.
Section 3. Severability.
If any provision of this ordinance is declared invalid, the remaining provisions shall remain in effect.
Section 4. Repealer.
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.
Section 5. Effective Date.
This ordinance shall become effective upon adoption and publication as required by law.
