The current injunction specifically discusses the economic injury suffered by commercial plaintiffs and the commercial members of the associational plaintiffs when NFA enforcement causes customers to avoid purchasing NFA fi****ms from them.

The Court stated that commercial members are injured by “customers’ reluctance to purchase NFA fi****ms from them because of the challenged NFA provisions” and concluded that, to provide complete relief, the injunction must encompass their current and future customers in transactions with those commercial members.

In other words: the Court expressly recognized LOST PROFITS and LOST BUSINESS as an injury to covered commercial plaintiffs and commercial members.
