“A well regulated Militia, being necessary to the security of a free State"
At the time the 2nd Amendment was written, our language and terms used was vastly different that the meanings those words have today. Even terms and words we used just 10 years ago have different societal meanings than they do today; so that must FIRST be acknowledged before delving into the answer to this.
At the time the 2A was written, the term “Regulars” is the word which was used to define, or describe, “Military personnel”, or soldiers. While the term “Militia” is what was used to describe the average citizen who decided to take up arms.
With that out of the way, now we can explain that a “Well Regulated Militia” was in reference to the citizenry of civilians who either were, would, or could take up arms. They were to be “Well Regulated” so that the amount, type and power of arms which they had access to was the same as that of the Regulars…. hence, “Regulated”.
It says “State” because at that time the Union had not been formed, and each State was it’s own authority individual entity. Prior to the Union being formed and the creation of the federal Government, the USA was titled as “The United States ARE America”, and after the Union was formed it then became the “United States OF America”.
Because military (Regulars) numbers were low as a result of us being a new Nation, we often depended fully on the aid, and assistance of the Militia during times of conflict…. Just like in the Independence war, aka (Revolutionary War), where more Militia (citizens) engaged in battle against the British than actual Regulars.
Our Founding Fathers recognized this, and they also recognized the fact that any Government would, and could, evolve to have full legal authority over any creation or growth of any Military, therefore an independent body of men capable to protect the FREEDOM of a FREE State was the difference between survival or demise of our Nation… If the Govt controlled the Militia, then there would be no body of citizens to protect against a tyrannical Government.
Therefore, the 2nd Amendment was drafted and ratified into law to protect the FREEDOMS of this new Nation and prevent Government Tyranny which we had just fought against in the Revolutionary War. a Well Regulated (Armed) Militia (Citizenship) was essential, and NECESSARY to the Freedom of the State, and they knew this!
The 2A was therefore drafted to prevent the Government from becoming Tyrannical and attempting to disarm the citizens. That’s why it follows up with, “Shall Not Be Infringed”, which means to “Break an Agreement”.
The Government can NOT legally break the agreement of the 2A, and therefore ANY and EVERY law which prohibits, restricts, or attempts to place regulations on free ownership of ANY “arm” (firearm) is therefore both Unconstitutional, Illegal, and a direct violation of the Legal Authority of the U.S. Constitution.
