We agree 100% with Arkansas Armorys post. Graceland Outdoors will follow the same current process until we receive Official BATFE instructions and requirements rather new or deleted. Appreciate ya’lls patience. I’ll update as soon as I get the official instructions.
PS: Don’t let this stop you from procuring a suppressor. Either way, we will make it happen.
We have received a lot of questions today about the federal court ruling in Silencer Shop Foundation v. ATF and whether Arkansas Armory will begin transferring suppressors without ATF Form 4 approval.
First, we are excited about the ruling. Arkansas Armory strongly supports making lawful suppressor ownership simpler, and we hope this case ultimately results in the removal of unnecessary federal NFA registration and approval requirements for suppressors.
For now, however, Arkansas Armory will continue using the established Form 4 process.
The reason is practical, not political. The court's injunction is limited and whether a particular transaction is covered can depend on the specific parties, customers, memberships and commercial participants involved. At the same time, suppressors are still being transferred to Arkansas Armory by distributors through ATF Form 3s, which places those suppressors into our federal NFA inventory records. ATF has not yet provided dealers with a clear process for reconciling those records after a customer transfer completed without a Form 4.
We also need to be able to document why every suppressor that leaves our inventory was lawfully transferred and to be able to explain that transaction later during an ATF inspection or legal review. Right now, too many important operational questions remain unanswered.
We respect the decision Silencer Shop and other businesses may make about operating under the injunction, and we are not telling other dealers what risk they should or should not accept. Arkansas Armory simply is not willing to make our customers, our employees or our federal fi****ms license part of an avoidable legal test case while the process is still developing.
So, for the time being, suppressors transferred through Arkansas Armory will continue through the normal Form 4 process. We will follow the litigation and any ATF, DOJ and industry guidance closely, and if a clear, durable and auditable no-Form-4 process develops, we will reevaluate our policy promptly.
We are encouraged by where this may be headed. We just want to get there in a way that protects our customers and lets us continue serving the fi****ms community for the long term.
