The State Is Dragging This Out
Here is the latest from the status conference with Judge Browning—and here’s the truth in a nutshell:
The 7-day waiting period is still in effect — not because the court is unsure, but because the State refuses to back down.
Judge Browning made it clear he was ready to issue a final judgment today. Instead, the State chose to keep fighting — dragging this case out even further at the expense of law-abiding New Mexicans.
Let’s be clear about what’s happening here:
This is no longer about legal uncertainty.
According to Mountain States Legal Foundation, this is quickly becoming an exercise in futility.
Yet the State continues to push forward — using taxpayer dollars to defend a law that is already on shaky constitutional ground.
What Happens Next
Because the State won’t concede, we now move into the final phase of this case:
April 20 – Motion for Summary Judgment
May 11 – State’s Response
June 2 – Final Hearing
July 1 – Final Replies
Judge Browning expects to issue a decision by August 28 — possibly sooner.
Here’s the Key Point
Judge Browning stated he is bound by the Tenth Circuit Court of Appeals.
That means the legal framework is already set — and the State knows it.
But instead of acknowledging that reality, they are choosing to delay, obstruct, and spend more taxpayer money prolonging the inevitable.

Mountain States Legal Foundation will now be seeking attorneys’ fees from the State.
That means New Mexico taxpayers could soon be footing the bill — not just for defending this law, but for losing it.

A final decision is coming — but it’s being unnecessarily delayed by the State
