We are sure everyone has seen it already. As of 10-09-2026, there are some big changes concerning NFA items like Silencers, SBRs, and SBSs.
Yesterday, 10-09-2026, ATF Director Robert Cedaka released an open letter providing guidance concerning the current injunction involving plaintiffs SS, GOA, and several others. The most important takeaway from this is that no laws currently in the NFA or GCA have been repealed. They have simply stated that they will not be enforced at this time. What does this exactly mean? It means that if a different administration or ATF Director gets into office and decides to enforce these laws, then they will be resume again. To add uniformity to the injunction, those who are not covered under it will be able to utilize the same method of filling out a 4473 for silencers, SBRs, and SBSs since they have now been categorized as a "fi***rm". He went on to state that the filing of NFA required forms such as Form 1,3, and 4s is strictly voluntary at this current time. This is with the understanding that, in the event the ruling should change, you will then potentially be in illegal possession of a non-registered NFA item.
The ATF has provided a Q&A, which can be viewed at https://www.atf.gov/fi****ms/update-to-nfa-transfer-guidance . We encourage everyone to review it, paying attention especially to the "Future Risk" section, and determine how this new ruling affects them individually.
At this time, Chris' Customs LLC will transition to the Form 4473 for transfers, with the proper FBI NICS background check. We will also still offer the NFA Form 4 route if you want that extra layer of protection. Since these NFA items are now being categorized as "Fi***rms", you still must be a minimum age of 21 and legally eligible to own or possess a fi***rm. Since the new ruling still requires us to maintain our SOT to conduct this type of business, at this time, our Transfer rate will remain unchanged. Everyone must understand South Carolina laws still apply and do not supercede Federal Law.
