The Third Circuit ruled that New Jersey's bans on commonly owned semiautomatic rifles and standard-capacity magazines violate the Second Amendment, then turned around and let the state keep enforcing those same unconstitutional laws while it runs to the Supreme Court. On August 4, the court granted New Jersey's request to stay its own July 17 mandate, meaning the bans remain criminally enforceable even though ten of the court's fifteen judges already found them illegal.

That en banc ruling was historic. It's the first time a federal appeals court struck down a state assault weapons ban, holding that AR-15-style rifles are plainly "Arms" under the Second Amendment and that magazines aren't accessories but essential parts of how these fi****ms function. New Jersey argued that letting citizens actually buy the rifles and magazines the court says they have a right to own would cause the state "irreparable harm." Read that again: the government called the restoration of a constitutional right an injury to itself.

This isn't just a New Jersey problem. The Ninth Circuit upholds California's magazine ban while the Third Circuit strikes down New Jersey's nearly identical law, and the Duncan v. Bonta petitioners just used that split to push the Supreme Court to finally settle the question nationwide. Until the justices act, the same magazine is a protected constitutional right in Pennsylvania and a felony in New Jersey and California. New Jersey didn't win its case. It bought itself more time to keep enforcing a law its own appellate court already declared unconstitutional.
