Hey neighbors. I hope you are having a great weekend.

I wanted to post a bit of information regarding the swirl of interest in the ruling this week regarding suppressors.

As you are probably aware, Silencer Shop, GOA and other plaintiffs have won an injunction to remove suppressors, SBR's and other items off the NFA ( National Fi****ms Act of 1934) list. Silencer Shop did a well publicized suppressor transfer to Firearm Advocate Brandon Herrera. As you can imagine this set off a flurry of phone calls and text regarding folks being able to come into Mansfield Fi****ms and duplicate the process.

Unfortunately, There are legal guidelines I must follow to keep my licenses.

As a FFL/Sot dealer, I have to follow the rules with regards to transferring NFA items such as suppressors. That guidance has to come from the governing federal agency, not the social media.
Thursday morning, I placed a call to ATF to get more information about transferring a suppressor (NFA item) without filing a form 4. The answer I got was disturbing but yet predictable- They didn't know...The agency that guides dealers like myself didn't have a plan in place for the lawsuit.
So... what does that mean? - it's business as usual with transferring current inventory suppressors from my shop. Fingerprints, photo and creating a Eforms account for customers that want a suppressor are still in place. The cost for this is still zero.

However...individuals that purchase suppressors from Silencer Shop and choose my shop as the transfer agent will be able to fill out a standard 4473 and firearm style background check. This work around will be legal as SS will not Form 3 these suppressors to my shop, thus allowing me to log it in as a "other firearm"- not an NFA item

Whew.

It's my understanding that ATF is scheduled to shed more light on the process next week. I promise to give updates on here as I receive them.
