𝗨𝗻𝗱𝗲𝗿 𝘁𝗵𝗲 𝗖𝗼𝗱𝗲 𝗼𝗳 𝗣𝗿𝗼𝗳𝗲𝘀𝘀𝗶𝗼𝗻𝗮𝗹 𝗥𝗲𝘀𝗽𝗼𝗻𝘀𝗶𝗯𝗶𝗹𝗶𝘁𝘆 𝗮𝗻𝗱 𝗔𝗰𝗰𝗼𝘂𝗻𝘁𝗮𝗯𝗶𝗹𝗶𝘁𝘆, a lawyer shall not advertise legal services except with the use of dignified, verifiable, and factual information, and in no case shall it be self-laudatory. 𝗙𝘂𝗿𝘁𝗵𝗲𝗿𝗺𝗼𝗿𝗲, 𝘁𝗵𝗲 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁 𝗵𝗲𝗹𝗱 𝘁𝗵𝗮𝘁 the practice of law is a profession, not a business. A lawyer cannot advertise their talents in a manner similar to a merchant advertising goods.

𝗛𝗲𝗿𝗲, Atty. Bella's advertisement for "Guaranteed Quick Annulments in 30 Days" and "Cheapest Rates in Town" is misleading, undignified, and treats the legal profession as a mere commercial enterprise.

𝗧𝗵𝘂𝘀, the advertisement is improper and unethical.

𝐓𝐡𝐞 𝐧𝐨𝐭𝐚𝐫𝐢𝐚𝐥 𝐚𝐜𝐭 𝐨𝐟 𝐀𝐭𝐭𝐲. 𝐗 𝐢𝐬 𝐯𝐚𝐥𝐢𝐝, 𝐰𝐡𝐢𝐥𝐞 𝐭𝐡𝐞 𝐧𝐨𝐭𝐚𝐫𝐢𝐚𝐥 𝐚𝐜𝐭 𝐨𝐟 𝐀𝐭𝐭𝐲. 𝐘 𝐢𝐬 𝐢𝐧𝐯𝐚𝐥𝐢𝐝.

𝐔𝐧𝐝𝐞𝐫 𝐭𝐡𝐞 𝐑𝐮𝐥𝐞𝐬 𝐨𝐧 𝐄𝐥𝐞𝐜𝐭𝐫𝐨𝐧𝐢𝐜 𝐍𝐨𝐭𝐚𝐫𝐢𝐳𝐚𝐭𝐢𝐨𝐧, an Electronic Notary Public (ENP) has nationwide jurisdiction and is authorized to perform electronic notarial acts anywhere in the Philippines. 𝐈𝐧 𝐜𝐨𝐧𝐭𝐫𝐚𝐬𝐭, 𝐮𝐧𝐝𝐞𝐫 𝐭𝐡𝐞 𝟐𝟎𝟎𝟒 𝐑𝐮𝐥𝐞𝐬 𝐨𝐧 𝐍𝐨𝐭𝐚𝐫𝐢𝐚𝐥 𝐏𝐫𝐚𝐜𝐭𝐢𝐜𝐞, a notary public may only perform traditional notarial acts within the territorial jurisdiction of the commissioning court.

𝐈𝐧 𝐭𝐡𝐢𝐬 𝐜𝐚𝐬𝐞, Atty. X, as an ENP, can validly perform Remote Electronic Notarization, for a client in Cebu despite being commissioned in Quezon City. 𝐎𝐧 𝐭𝐡𝐞 𝐨𝐭𝐡𝐞𝐫 𝐡𝐚𝐧𝐝, Atty. Y, as a traditional Notary Public, can perform notarial acts only in Quezon City; thus, notarizing a Deed of Sale for a client in Makati City violates the territorial jurisdiction.

𝐓𝐡𝐞𝐫𝐞𝐟𝐨𝐫𝐞, Atty. X's electronic notarization is valid, while Atty. Y's traditional notarization is invalid.

𝐍𝐨, Xavier’s defense is untenable.

𝐉𝐮𝐫𝐢𝐬𝐩𝐫𝐮𝐝𝐞𝐧𝐜𝐞 dictates that the practice of law is not a natural, property, or constitutional right, but a mere privilege imbued with public interest. In 𝐴𝑔𝑢𝑖𝑟𝑟𝑒 𝑣. 𝑅𝑎𝑛𝑎, the Supreme Court ruled that passing the bar examinations is not enough; one must also take the oath and sign the Roll of Attorneys to be a full-fledged lawyer. Furthermore, the practice of law is a privilege bestowed only on the morally fit.

𝐈𝐧 𝐭𝐡𝐢𝐬 𝐜𝐚𝐬𝐞, Xavier engaged in the unauthorized practice of law by holding himself out as counsel and filing pleadings before taking the Lawyer's Oath and signing the Roll of Attorneys. By acting as a lawyer without authority, Xavier demonstrated a lack of moral fitness, which justifies the Supreme Court in denying his admission to the legal profession.

𝐓𝐡𝐞𝐫𝐞𝐟𝐨𝐫𝐞, Xavier’s defense is untenable.

𝐘𝐞𝐬, 𝐛𝐮𝐭 𝐰𝐢𝐭𝐡 𝐬𝐭𝐫𝐢𝐜𝐭 𝐥𝐨𝐜𝐚𝐭𝐢𝐨𝐧 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬.

A person residing abroad can execute a Special Power of Attorney (SPA) and have it electronically notarized by an 𝐄𝐥𝐞𝐜𝐭𝐫𝐨𝐧𝐢𝐜 𝐍𝐨𝐭𝐚𝐫𝐲 𝐏𝐮𝐛𝐥𝐢𝐜 (𝐄𝐍𝐏) 𝐢𝐧 𝐭𝐡𝐞 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞𝐬, but they cannot do it from their home or workplace.

Under the 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁'𝘀 𝗥𝘂𝗹𝗲𝘀 𝗼𝗻 𝗘𝗹𝗲𝗰𝘁𝗿𝗼𝗻𝗶𝗰 𝗡𝗼𝘁𝗮𝗿𝗶𝘇𝗮𝘁𝗶𝗼𝗻 (𝗔.𝗠. 𝗡𝗼. 𝟮𝟰-𝟭𝟬-𝟭𝟰-𝗦𝗖), the following conditions must be strictly met:

1. 𝐏𝐡𝐲𝐬𝐢𝐜𝐚𝐥 𝐏𝐫𝐞𝐬𝐞𝐧𝐜𝐞 𝐚𝐭 𝐚 𝐂𝐨𝐧𝐬𝐮𝐥𝐚𝐭𝐞 - At the exact time of the video conference for the electronic notarization, 𝐭𝐡𝐞 𝐩𝐫𝐢𝐧𝐜𝐢𝐩𝐚𝐥 𝐦𝐮𝐬𝐭 𝐛𝐞 𝐩𝐡𝐲𝐬𝐢𝐜𝐚𝐥𝐥𝐲 𝐢𝐧𝐬𝐢𝐝𝐞 𝐚 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞 𝐄𝐦𝐛𝐚𝐬𝐬𝐲, 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞 𝐂𝐨𝐧𝐬𝐮𝐥𝐚𝐫 𝐎𝐟𝐟𝐢𝐜𝐞, 𝐨𝐫 𝐨𝐟𝐟𝐢𝐜𝐞 𝐨𝐟 𝐚 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞 𝐇𝐨𝐧𝐨𝐫𝐚𝐫𝐲 𝐂𝐨𝐧𝐬𝐮𝐥.

2. 𝐕𝐢𝐝𝐞𝐨 𝐯𝐞𝐫𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧 - The ENP will require the principal to pan their camera to visually confirm they are inside the embassy or consulate premises.

3. 𝐎𝐟𝐟𝐢𝐜𝐢𝐚𝐥 𝐂𝐨𝐧𝐟𝐢𝐫𝐦𝐚𝐭𝐢𝐨𝐧 - A designated officer from the embassy or consulate must speak to the ENP to confirm that the principal is indeed present within their premises before the notarization can proceed.

𝐃𝐢𝐬𝐜𝐥𝐚𝐢𝐦𝐞𝐫: This electronic notarization is simply an alternative option. It does not amend or replace the Apostille process, which remains fully valid and is governed by separate international rules.
