PANALO ANG SAN JOSEÑO! DALAWANG TRO PETITION NG PRIMEWATER LABAN SA LGU, IBINASURA NG MGA KORTE

SAN JOSE DEL MONTE CITY, Bulacan — Magkasunod na ibinasura ng Regional Trial Court (RTC) ng Bulacan at RTC ng Las Piñas ang mga petisyon ng PrimeWater Infrastructure Corp. para sa Temporary Restraining Order (TRO) at preliminary injunction laban sa Pamahalaang Lungsod ng San Jose del Monte at sa pansamantalang pangangasiwa nito sa lokal na operasyon ng tubig.

Sa desisyon ng RTC Bulacan noong Mayo 26, 2026, sinabi ng korte na hindi napatunayan ng PrimeWater ang pangangailangan para sa agarang pagpapatigil sa mga hakbang ng lokal na pamahalaan upang tugunan ang krisis sa suplay ng tubig. Binigyang-diin din ng hukuman na mas mahalaga ang kapakanan ng mamamayan kaysa sa mga obligasyong nakapaloob sa Joint Venture Agreement ng PrimeWater at ng San Jose del Monte Water District.

Ayon sa datos ng Pamahalaang Lungsod, mahigit 47,611 kabahayan o humigit-kumulang 250,000 residente sa 62 barangay ang apektado ng problema sa distribusyon ng tubig.

Kinilala rin ng RTC Bulacan ang legal na batayan ng interbensyon ng LGU sa ilalim ng City Ordinance No. 2026-03-012 at Provincial Resolution No. 293-2026, na nagbibigay kapangyarihan sa alkalde na pansamantalang pangasiwaan ang operasyon ng serbisyo ng tubig sa panahon ng state of emergency.

Matapos mabigo sa Bulacan, naghain muli ang PrimeWater ng kaparehong petisyon sa RTC Las Piñas. Ngunit noong Hunyo 2, 2026, muli itong ibinasura ng korte dahil hindi umano napatunayan ng kumpanya na makakaranas ito ng matinding at hindi na maibabalik na pinsala kung hindi ito pagkakalooban ng TRO.

Ikinatuwa naman ni Mayor Florida “Ate Rida” Robes ang mga desisyon ng korte. Aniya, nagbibigay ito ng pagkakataon sa lokal na pamahalaan na ipagpatuloy ang mga hakbang upang mapabuti ang serbisyo ng tubig at matugunan ang matagal nang suliranin ng mga residente ng San Jose del Monte.
