🔴 CONVICTED RA**ST USED HIS BROTHER’S IDENTITY FOR 17 YEARS — IMMIGRATION NEW ZEALAND APPROVED RESIDENCE DOCUMENTS UNDER THE FALSE NAME, AND HE ENDED UP WITH 12 MONTHS’ HOME DETENTION

James McLeod Bennett was born in New Zealand and had a criminal history stretching across decades and across several countries.

By the time he was sentenced over the passport fraud in 2023, he was 66 years old and had accumulated 34 New Zealand convictions between 1976 and 2016, including seven s*x offences, two offences involving stupefying victims, and 21 dishonesty offences.

In 1996, Bennett was convicted of r**e and abduction and sentenced to 9½ years in prison.

🔴 AUSTRALIA HAD ALREADY DEPORTED HIM BACK TO NEW ZEALAND

Bennett had also lived in Britain and Australia and accumulated criminal records in both countries.

After moving to Australia, Bennett was deported back to New Zealand at the age of 29 because of convictions he had accumulated there.

The publicly available reporting does not identify the individual Australian offences, but Bennett himself later acknowledged having an extensive criminal history in New Zealand, Australia and Great Britain.

So Australia had already decided it did not want him remaining there.

🔴 HIS CRIMINAL HISTORY WAS GETTING IN THE WAY OF INTERNATIONAL TRAVEL

Bennett knew that travelling under his real identity exposed his extensive criminal history.

So in 2003, he used the identity of his younger brother, William Lindsay Bennett, to obtain a genuine British passport.

He supplied his brother’s personal details but used his own photograph.

Bennett later admitted he obtained the passport in his brother’s identity so he could travel internationally without his criminal history affecting his movements.

🔴 HE BUILT AN ENTIRE FALSE IDENTITY AROUND IT

Bennett did not stop at the passport.

Using his brother’s identity, he obtained a New Zealand driver’s licence.

He then used the licence and false British passport to open an ASB bank account in William’s name.

Then, in November 2004, Bennett presented that British passport to Immigration New Zealand in an application for a Returning Resident Visa.

Immigration New Zealand approved it.

The visa was placed into a passport carrying another man’s identity — but Bennett’s photograph.

🔴 IMMIGRATION NEW ZEALAND APPROVED THE FALSE IDENTITY AGAIN IN 2017

More than a decade later, Bennett repeated the deception.

In January 2017, he obtained a second British passport in William’s name, again carrying Bennett’s own photograph.

He then applied to Immigration New Zealand to have his Permanent Resident Visa transferred into that second passport.

Immigration New Zealand approved that application as well.

So this was not a single missed check.

The same false identity was accepted by New Zealand’s immigration system more than once.

🔴 HOW DID THEY NOT PICK UP WHO HE ACTUALLY WAS?

This was not an unknown foreign national whose history existed only overseas.

Bennett was born in New Zealand.

He had decades of convictions here.

He had served a lengthy prison sentence for r**e and abduction.

His real identity and criminal history already existed in New Zealand records.

Yet Immigration New Zealand accepted immigration documentation under another man’s identity while the photograph was Bennett himself.

That raises an obvious question:

🔴 HOW DID IMMIGRATION NEW ZEALAND FAIL TO CONNECT HIS FACE WITH HIS REAL NEW ZEALAND IDENTITY AND CRIMINAL RECORD?

That question becomes even more serious when the false identity was accepted again in 2017, when biometric and identity-verification technology was already a major part of modern border systems.

🔴 HE TRAVELLED UNDER THE FALSE IDENTITY FOR ABOUT 17 YEARS

Bennett used the fraudulent identity to travel internationally for roughly 17 years.

Reporting identifies travel involving Fiji, Australia, Kuala Lumpur, Beijing and Bangkok, among other destinations.

Immigration New Zealand later acknowledged that the false identity enabled Bennett to enter countries that might not otherwise have admitted him if his real identity and extensive criminal record had been known.

The false identity therefore had a very specific purpose:

to hide who he really was and the criminal history attached to his real name.

🔴 BENNETT SAID HIS BROTHER KNEW HE WAS USING HIS IDENTITY

When Bennett was eventually challenged, he admitted the fraud.

He also claimed that his brother William knew about the arrangement and had given him his British passport and Australian driver’s licence so Bennett could use the correct personal information.

That is Bennett’s account; the available material does not establish that William was prosecuted.

🔴 OTHER COUNTRIES WERE ENTITLED TO KNOW WHO THEY WERE LETTING IN

Judge Gregory Hikaka said the countries Bennett travelled to had every right to be concerned about the extent and nature of his convictions.

Given Bennett’s extensive s*xual-offending history, there is also an obvious public-safety issue:

Foreign border authorities were assessing a man travelling under William Bennett’s identity — not James Bennett’s real identity and criminal record.

There is no evidence that Bennett committed further s*xual offending on those trips, but the countries he entered were entitled to know exactly who was crossing their borders.

🔴 SEVENTEEN YEARS OF FALSE-IDENTITY FRAUD — AND THE FINAL SENTENCE WAS 12 MONTHS’ HOME DETENTION

This is one of the most extraordinary parts of the case.

Bennett used his brother’s identity for about 17 years.

He obtained genuine British passports under that identity.

He obtained a New Zealand driver’s licence.

He opened a bank account.

He obtained New Zealand immigration documentation.

He travelled internationally under the false identity while concealing his extensive criminal history.

The sentencing judge began with a starting point of three years’ imprisonment.

That was reduced to 27 months for Bennett’s guilty pleas, and after further reductions his final sentence for the passport and identity offending became:

🔴 12 MONTHS’ HOME DETENTION.

The judge warned Bennett that breaching the sentence could result in imprisonment.

But the final outcome remained 12 months at home for offending that had continued for approximately 17 years.

Seventeen years of deliberate and sophisticated false-identity offending — 12 months’ home detention.

🔴 HIS HOME-DETENTION SENTENCE HAS NOW FINISHED

The passport case was sentenced in 2023, meaning that 12-month home-detention sentence has long since ended.

There is no public information in the material reviewed showing that Bennett was subsequently imprisoned again.

So the broader reality is that a man with seven New Zealand s*x-offence convictions, including r**e and abduction, an extensive international criminal history, and approximately 17 years of false-identity offending is no longer serving the sentence imposed in this case.

🔴 HOW MANY OTHERS HAVE NEVER BEEN CAUGHT?

This case raises a much wider question about Immigration New Zealand’s identity checks.

If a New Zealand-born man whose criminal record already existed inside this country could obtain immigration documentation under another person’s identity — and have that identity accepted again years later — what does that say about the checks being performed?

And how many other people have successfully entered or moved through New Zealand’s immigration system using false identities that have simply never been discovered?

The public only ever hears about the ones who eventually get caught.
