We hereby advise members and supporters of the Greytown Community Gym Inc that applications have been filed for injunctions (and other Court applications) have commenced against the persons operating the bank accounts of the gym and purporting to represent the committee, due to ongoing serious dysfunction and a large and growing number of complaints from members and former members, such as the following examples.
Since being elected Secretary two years ago I have repeatedly requested access to correspondence, membership forms and other basic information required to perform the functions of Secretary of an incorporated society according to the Constitution of the Greytown Community Gym. Along with other committee members I requested access to the bank statements after receiving complaints about money not being banked, payments disputed, etc. These requests have been repeatedly refused by the current Treasurer and President, who are acting ultra vires (without legal authority).
Notice will be sent out shortly regarding the AGM and nominations are invited for the positions of President and Treasurer.
In addition to my role as Secretary I have also cleaned the gym for several years. Recent refusal to pay me for cleaning the gym (well prior to Covid) or reimburse me for cleaning products and replacement gym equipment, unauthorised changing of the lock, unauthorised removal of assets, etc, are totally unacceptable and we have no doubt that the Court will agree.
At least one of the signatories of the bank account (or "persons authorised to operate the accounts") has not even been a member of society for several years - the Constitution is very clear about all these issues.
It's clear that there has been misleading information circulated by Don and Noeline regarding the proposal outlined in the SWDC annual plan. The Gym's lease with the Rugby Club expired well over a year ago, this has been repeatedly discussed along with the problems with the bank accounts and membership forms - all this has been well documented and the information will be released because it is in the public interest to know what's going on.
I've invested a great deal into the Greytown Community Gym and so have certain other committee members and we are no longer prepared to tolerate this blatant fraud, or the bullying, or the incompetence. These complaints speak for themselves, they are two of many we received after publicising our email address in the Greytown Grapevine in August or September last year. More information will be provided regarding these matters shortly.
Noeline and Don called what they referred to as a special general meeting on 27 November 2019 "for the purpose of electing a new committee." Repeated requests for a copy of the minutes of that meeting - or any meeting held since - have been refused. I and another committee member were physically threatened by Don, shouted at by him and Noeline, and bullied out of the meeting as soon as we attempted to raise the issue of the many complaints such as the ones evidenced below. It is clear that the committee, and the operation of the society, is seriously dysfunctional, and that is due largely to Don and Noeline and their obstinate refusals to update the account signatories, share access to the membership forms, correspondence and other information, and adhere to the Constitution of our society.
We invite nominations for the positions of President and Treasurer - attempts to remove me and retain the status quo in regard to enabling the bullying and unlawful operation of the bank accounts and the other incompetence and misfeasance will not be tolerated by me and I have no doubt whatsoever that the Court will uphold our claims and attempts to do so will result in further Court action.
We refrained from advising members of these matters out of a desire to avoid shame to Don and Noeline but their repeated arrogance is intolerable. Our community deserves better than this.
