( Myanmar Customs Tariff 2022 ) HS Codeဆိုတာဘာလဲ ???

ကမ္ဘာ့အကောက်ခွန်အဖွဲ့သည် Harmonized Commodity Description and Coding System (Harmonized System - HS– 2022 )Version ကို ၂၀၂၂ ခုနှစ် ဇန်နဝါရီလ ၁ ရက်နေ့တွင် စတင်ကျင့်သုံးရန် အတည်ပြုခဲ့ပြီးဖြစ်ပါတယ်။

အဖွဲ့ဝင်နိုင်ငံများအနေဖြင့် နိုင်ငံအလိုက် HS 2017 မှ HS 2022 ကို ပြောင်းလဲ ကျင့်သုံးရန် ဆောင်ရွက်ကြရပါတယ်။

အာဆီယံနိုင်ငံတွေ အနေနဲ့ ( WCO HS )ကို အခြေခံသည့် ASEAN Harmonized Tariff and Nomenclature – AHTN 2022 ကို ညှိနှိုင်း သဘောတူပြီး ဖြစ်လို့ ယခု ၂၀၂၂ ခုနှစ်အတွင်း စတင်ကျင့်သုံးခဲ့သည်။

HS ( Harmonized System )ရဲ့သမိုင်းကြောင်း

[ကုန်သွယ်သည့်နိုင်ငံအားလုံးက ဘုံသဘောတူကျင့်သုံးသည့် စနစ်တစ်ရပ် ဖြစ်ပေါ်ရေး အားထုတ်ကြရာက ၁၉၈၈ ခုနှစ်တွင် စတင်ကျင့်သုံးခဲ့သည့် စနစ်တစ်ခုဖြစ်ပါတယ်။

ဒီစနစ် မတိုင်မီ ပထမဆုံး နိုင်ငံတကာ စာရင်းအင်းဆိုင်ရာကုန်ပစ္စည်း အမည်ပေးစနစ် - International Statistical Nomenclature ကို ၁၉၁၃ ခုနှစ်မှာ စတင် လက်ခံ ကျင့်သုံးခဲ့ပါတယ်။ ယင်းနောက် အကောက်ခွန်တွေရဲ့ ပထမဆုံး အမည်ပေးစနစ်ကို ၁၉၃၁ ခုနှစ်မှာ League of Nations က လက်ခံကျင့်သုံးခဲ့ပြီး ယင်းအား Geneva Nomenclature ဟုခေါ်ဆိုခဲ့ပါတယ်။

၁၉၃၈ ခုနှစ်တွင် League of Nations က “Minimum list of Commodities for International Trade Statistics” ကိုထုတ်ပြန်ခဲ့ပါသည်။ ယင်းတွင် လိုအပ်သလို ပြင်ဆင်ရန် အချက်အများအပြားရှိသည့်အတွက် United Nations သည် ကျွမ်းကျင်သူ အကြံပေးများနှင့်ညှိနှိုင်း၍ the United Nations Standard International Trade Classification (SITC) (1950 edition) ကိုထုတ်ပြန်ခဲ့ပါသည်။

The Customs Co-operation Council – ( CCC )ဖွဲ့စည်းရေး ကွန်ဗန်းရှင်း ၄-၁၁-၁၉၅၂ တွင် စတင်သက်ဝင်ပါသည်။ ( CCC )က Brussels Tariff Nomenclature (BTN) ကို ၁၉၅၅ ခုနှစ်တွင် ဖြန့်ချီပါသည်။ ယင်းအား ၁၉၇၄ တွင် Customs Cooperation Council Nomenclature (CCCN) ဟု အမည်ပြောင်းခဲ့ပါသည်။ယင်း ( CCCN )ကို အဓိကအခြေခံ၍ HS ကို တည်ဆောက်ခဲ့ခြင်းဖြစ်တယ်။ ဒီလိုဆောင်ရွက်ရာမှာ the SITC၊ the European Community Nomenclature၊ the United States Nomenclature၊ the Canadian Nomenclature နှင့် the Japanese Nomenclature တို့ဆီက နမူနာအချို့ ကို အသုံးပြုခဲ့ပါတယ်။] (စာကိုး)

HS ကို ၁၉၈၈ ခုနှစ်မှာ စတင်ကျင့်သုံးတယ်။ အစပိုင်းမှာ ၄ နှစ်တစ်ကြိမ်ပြင်ခဲ့ပါတယ်။ ၁၉၉၂၊ ၁၉၉၆ ခုနှစ်တို့ဖြစ်ပါတယ်။ ၂၀၀၂ ခုနှစ်မှာ ပြင်ခဲ့ပြီး ယင်းနောက်ပိုင်း ၅ နှစ်တစ်ကြိမ် ၂၀၀၇၊ ၂၀၁၂၊ ၂၀၁၇ နှင့် ၂၀၂၂ တို့ဖြစ်ပါတယ်။

၁။ ပေးဆောင်ရမည့် အကောက်ခွန် (Tariff) ကို တိကျစွာ သတ်မှတ်နိုင်ခြင်း။

ဒါဟာ အရေးကြီးဆုံး အချက်ဖြစ်ပါတယ်။ ကုန်ပစ္စည်းတစ်ခုရဲ့ HS Code ပေါ်မူတည်ပြီး အစိုးရကို ပေးဆောင်ရမည့် သွင်းကုန်ခွန် (Import Duty)၊ ကုန်သွယ်လုပ်ငန်းခွန် (Commercial Tax) စတာတွေ ဘယ်လောက်ကျသင့်မလဲဆိုတာ တွက်ချက်ရတာ ဖြစ်ပါတယ်။ ကုဒ်နံပါတ် မှားသွားရင် အခွန်ပိုပေးရတာမျိုး ဒါမှမဟုတ် အခွန်ရှောင်သလိုဖြစ်ပြီး ဒဏ်ရိုက်ခံရတာမျိုး ဖြစ်နိုင်ပါတယ်။

၂။ ကုန်သွယ်မှုဆိုင်ရာ စည်းမျဉ်းများနှင့် ကန့်သတ်ချက်များကို သိရှိနိုင်ခြင်း။

အချို့ကုန်ပစ္စည်းတွေ (ဥပမာ - ဆေးဝါး၊ ဓာတုပစ္စည်း၊ အစားအသောက်၊ တိရစ္ဆာန်ထွက်ပစ္စည်း) ကို တင်သွင်း/တင်ပို့မယ်ဆိုရင် သက်ဆိုင်ရာ ဝန်ကြီးဌာနတွေရဲ့ ထောက်ခံချက် (Recommendation) ဒါမှမဟုတ် သွင်းကုန်/ပို့ကုန် လိုင်စင် (License) လိုအပ်တတ်ပါတယ်။ HS Code ကို ကြည့်ခြင်းအားဖြင့် မိမိပစ္စည်းက ကန့်သတ်ကုန်ပစ္စည်း ဟုတ်မဟုတ်၊ ဘယ်ဌာနရဲ့ ခွင့်ပြုချက် လိုမလိုဆိုတာကို ကြိုတင်သိရှိနိုင်ပါတယ်။

၃။ အပြည်ပြည်ဆိုင်ရာ ကုန်သွယ်မှု သဘောတူညီချက်များ (FTAs) ဖြင့် အခွန်ကင်းလွတ်ခွင့် ရရှိနိုင်ခြင်း။

ဥပမာအားဖြင့် အာဆီယံနိုင်ငံအချင်းချင်း (သို့မဟုတ်) တရုတ်၊ ဂျပန်၊ ကိုရီးယား စတဲ့နိုင်ငံတွေနဲ့ ချုပ်ဆိုထားတဲ့ လွတ်လပ်သော ကုန်သွယ်မှု သဘောတူညီချက်တွေအရ အခွန်လျော့ပေါ့ခွင့် (သို့မဟုတ်) သုညရာခိုင်နှုန်းအထိ အခွန်ကင်းလွတ်ခွင့် ရရှိဖို့ဆိုရင် သက်ဆိုင်ရာ Form D, Form E ,…. တွေမှာတင်ပြရမယ့် HS Code က မှန်ကန်နေဖို့ အထူးလိုအပ်ပါတယ်။
