Astăzi a avut loc ședință ordinară de judecată pe dosarul panoului de escaladă instalat la Universitatea de Sport.
Ca și în cazurile anterioare, reprezentantul universității (avocatul) a încercat în toate modurile posibile să oprească procesul în sine. Aceasta a eșuat.
Mișcarea înainte este foarte lentă, dar două lucruri spun ceva:
1) Reprezentantul universității a spus în ședință următoarele: „Da, acceptăm, în baza facturilor de achiziții efectuate de către AO Pro-Trebujeni, că această instalație sportivă (panoul de escaladă) este proprietatea lor. Dar nu putem admite că dețin și sala în care este instalat.”
Nimeni nu a pretins vreodată proprietatea asupra sălii. Această învinuire la adresa noastră este falsă.

2) După ședința propriu-zisă, reprezentantul universității, din proprie inițiativă, a ridicat problema unui acord de mediere, același pe care universitatea l-a respins în urmă cu doi ani (aprilie 2021 =

Сегодня состоялось очередное судебное заседание по вопросу скалодрома в университет спорта.
Как и в предыдущих случаях, представитель университета (адвокат) пытался всяческими путями остановить сам процесс. Это не удалось.
Движение вперёд очень медленное, но два момента уже говорят о чём-то:
1) Представитель университета устно высказался на заседании следующим образом: «Да, мы признаём, что на основании представленных AO Pro-Trebujeni фактур о покупках, это спортивное сооружение (скалодром) является их собственностью. Но мы не можем признать, что им принадлежит зал, в котором оно установлено.»
Никто никогда не претендовал на владение залом. Эта бочка катится в наш адрес совершенно беспочвенно.

2) После самого заседания представитель университета, по собственной инициативе, поднял вопрос о соглашении о примирении, том самом, которое университет отверг два года назад (апрель 2021 г. =

Today, a regular court session on the issue of a climbing wall at the University of Sports took place.
As in previous cases, the representative of the university (lawyer) tried in every possible way to stop the process as such. It failed.
The forward movement is very slow, but two things already indicate something:
1) The representative of the university said in court the following: “Yes, we acknowledge that, based on the purchase invoices submitted by AO Pro-Trebujeni, this sports facility (climbing wall) is their property. But we cannot admit that they own the hall in which it is installed.”
No one has ever claimed ownership of the hall itself. This accusation against us is false.

2) After the session itself, the representative of the university, on his own initiative, raised the issue of a reconciliation agreement, the same one that the university rejected two years ago (April 2021 =

Ședința de judecată din 23 februarie 2022

Astăzi a avut loc o altă ședință de judecată care, după numai 10 minute, a fost reprogramată pentru o nouă dată în luna mai a acestui an. Amânarea ședinței a fost solicitată de către reprezentantul Universității, pe baza faptului că pârâtul are nevoie de timp pentru a se familiariza cu probele cu înscrisuri nou prezentate. Care sunt aceste probe surprinzătoare?
Acestea sunt:
1) Cel puțin 8 materiale video și foto pe care le-am găsit în domeniul public pe internet, și care arată că peretele de cățărat construit de noi este folosit de Universitate în scopuri didactice cu studenți, cel puțin.
2) Programul curricular a catedrei respective, precum și raportul de audit extern al Universității, consemnă faptul că Universitatea dispune de o întreagă „sală de escaladă”. Pe baza unui astfel de raport, Ministerul Educației alocă fonduri de la bugetul de stat pentru salariile cadrelor didactice și alte cheltuieli legate de procesul de învățământ.
3) Dovada faptului că există o diferență de un an între data participării noastre la concursul pentru grant și însuși intersecția cu Universitatea de Sport. Inițial, ne-am depus proiectul la concurs, l-am promovat cu succes, am semnat un contract cu donatorul și am implementat multe dintre activitățile acelui proiect, precum câteva instruiri în escaladă și o tabără sportivă de vară. După un număr mare de evenimente, odată cu sosirea perioadei răcoroase a anului 2014, am apelat la diverse instituții în căutarea spațiilor. Una dintre aceste instituții a fost glorioasa Universitate de Sport.

Necesitatea furnizării unor astfel de dovezi documentare se datorează faptului că de câțiva ani conducerea universității desfășoară o campanie activă de dezinformare, susținând că:
1) Universitatea nu folosește în niciun fel acest perete de cățărat și nu are deloc nevoie de el;
2) AO „Pro-Trebujeni” a primit grantul numai datorită sprijinului din partea Universității și numai prin aderarea la acest focar remarcabil de cunoștințe și cercetare științifică în domeniul sportului.

Toate acestea au fost auzite din nou în ultimele încercări de a încheia un acord de împăcare înainte de ședința de astăzi. În ședința anterioară, judecătorul a instruit părțile să se ocupe de aceasta.
Din păcate, nu s-a ajuns la un acord. Așa că suntem din nou în instanță.

Судебное заседание от 23 февраля 2022 года

Сегодня состоялось очередное судебное заседание, которое, спустя всего 10 минут, было перенесено на новую дату в мае сего года. Перенос заседания был запрошен представителем Университета, на основании того, что противоположная сторона должна ознакомиться с вновь представленными нами документальными свидетельствами. Что же это за свидетельства такие неожиданные?
Это:
1) Минимум 8 видео и фото материалов, которые мы обнаружили в открытом доступе в интернете, и которые показывают, что скалодром, построенный нами, используется Университетом в целях занятий со студентами, как минимум.
2) Учебный план соответствующей кафедры, а также отчёт внешнего аудита Университета, в котором зафиксирован факт наличия у Университета аж целого «скалолазного зала». На основании такого отчёта Министерство Образования выделяет позже средства из госбюджета на зарплату преподавателей и другие расходы, связанные с учебным процессом.
3) Доказательство того факта, что имеется год разницы между датой нашего участия в конкурсе на получение гранта и самим пересечением с Университетом спорта. Вначале мы подали наш проект на конкурс, прошли его успешно, подписали контракт с донором, выполнили многие мероприятия того проекта, как, например, тренинги в области скалолазания и летний спортивный лагерь. Уже после большого количества проведённых мероприятий, с наступлением прохладного периода 2014 года, мы обратились в разные учреждения в поиске помещения. Одним из таких учреждений оказался и славный Университет Спорта.

Необходимость представить такие документальные свидетельства вызвана тем, что на протяжении нескольких лет руководство университета ведёт активную дезинформационную кампанию, утверждая, что:
1) Университет никак не использует этот скалодром и вовсе он ему и не нужен;
2) ОА «Pro-Trebujeni» заполучила грант исключительно благодаря поддержке со стороны Университета и только пристроившись к этому выдающемуся рассаднику знаний и научных изысканий в области спорта.

Всё это пришлось заново услышать в последних попытках заключить мировое соглашение до сегодняшнего заседания. На предыдущем заседании судья поручил сторонам заняться этим делом.
К сожалению, соглашение не было достигнуто. Поэтому мы и снова в суде.

Court session of 23rd February 2022

Today, another court session took place, which, after only 10 minutes, was rescheduled for a new date in May of this year. The adjournment of the meeting was requested by the representative of the University, on the basis that they need time to familiarize themselves with the newly presented documentary evidence. What is this surprising evidence?
These are:
1) At least 8 video and photo materials that we found in the public domain on the Internet, and which show that the climbing wall built by us is used by the University for classes with students, at least.
2) The curriculum of the relevant department, as well as the report of the external audit of the University, record the fact that the University has a whole “climbing hall”. Based on such a report, the Ministry of Education allocates funds from the state budget for teachers' salaries and other expenses related to the educational process.
3) Evidence of the fact that there is a year difference between the date of our participation in the competition for a grant and the very intersection with the University of Sports. Initially, we submitted our project, passed successfully the selection process, signed a contract with a donor, and completed many of the activities of that project, such as several trainings in climbing and a summer camp. After a large number of events, with the onset of the cool period of 2014, we turned to various institutions in search of premises. One of these institutions was the glorious University of Sports.

The need to provide such documentary evidence is due to the fact that for several years the university management has been conducting an active disinformation campaign, arguing that:
1) The university does not use this climbing wall in any way and does not need it at all;
2) CA "Pro-Trebujeni" received the grant solely thanks to the support from the University and only by joining this outstanding hotbed of knowledge and scientific research in the field of sports.

All this was heard again in the last attempts to conclude a settlement agreement before today's court session. At the previous session, the judge instructed the parties to try to reach a deal.
Unfortunately no agreement was reached. So we are back in court.

Încercarea de mediere din 20 aprilie 2021

Vinerea trecută, 16 aprilie 2021, în biroul prorectorului Universității de Sport (USEFS) Andrei Toma, am convenit că vom încerca să rezolvăm litigiul prin mediere.
USEFS a insistat să ne întâlnim și să vorbim în biroul celui mai important șef de pe pământ - Rectorul Veaceslav Manolachi.
Ce fine că legea prevede că părțile lucrează și se întâlnesc în biroul mediatorului.
Îmi pot imagina ce fel de presiune mi-a fost pregătită în biroul lui Manolachi.

Astăzi, 20 aprilie 2021, părțile s-au întâlnit pe teritoriul neutru la biroul mediatorului.
După cm a indicat mediatorul, am prezentat un extras din registrul de stat al statutului meu în Asociația Pro-Trebujeni, plus buletinul de identitate. Aceasta înseamnă să te prezinți legal.

Din partea opusă, s-au prezentat doi bărbați care nu au prezentat NIMIC. Pe unul dintre ei l-am cunoscut mai devreme ca prorector USEFS pentru logistică (Andrei Toma). A doua persoană mi-a fost necunoscută și, după cm a răspuns mai târziu, nu a lucrat la/pentru USEFS nici în 2017, nici în 2018. Potrivit acestuia, el nu are cunoștință despre această chestiune și, chipurile, abia astăzi a aflat că ar trebui să vină la mediator cu această întrebare de apărare a intereselor USEFS. Această persoană s-a prezentat (oral) că are o pregătire de jurist și că este angajat actual al USEFS, chiar membru al consiliului.

Încă de la început, mediatorul a încercat să explice că nu are rost să negocieze dacă una dintre părți (USEFS) nu are puteri reprezentative legale. Cu toate acestea, reprezentanții USEFS au insistat să „vorbească” și în cele din urmă am pierdut mai mult de 1 oră din viața noastră.

Concluzia reuniunii este următoarea: mediatorul va întocmi un proces verbal pe care îl voi putea prezenta judecătorului și care va confirma faptul, că s-a încercat o mediere de către OA Pro-Trebujeni, care însă nu a reușit. Acest lucru mă va salva explicații inutile în instanță.

Deci, ce a durat peste o oră? Nu veți crede - un pressing. Este bine că a fost în prezența martorilor. Un alt avocat a fost prezent în același birou, pe lângă mediator. Acest pressing a fost destul de dur.
Când, cam la mijlocul ședinței, am insistat totuși ca „juristul” USEFS să prezinte orice document de identificare, cu dureri în suflet a scos un buletin și am fost convinși de identitatea sa.
Ca răspuns la aceasta, el m-a numit de mai multe ori „obraznic”, „arogant”, „incult”, „prost educat” și, în ansamblu, a trecut la „tu” cu mine și a început să mă amenință aproape. Toate cu martori independenți, în sfârșit!

Nu voi relua întreaga conversație. Interpretarea mea este că USEFS este extrem de îngrijorat de posibila pierdere a acestui caz în instanță.

În acest moment, instanțele sunt închise pentru carantină până la 1 mai. Știrile vor veni mai târziu.

Попытка медиирования от 20 апреля 2021 года

В прошедшую пятницу, 16 апреля 2021 г., в офисе проректора Университета Спорта (USEFS) Андрея Тома, мы сошлись на том, что попытаемся сотворить мировую через посредника/медиатора.
USEFS настаивала на встрече и беседах в офисе самого главного шефа на земле – ректора Вячеслава Манолаки.
Как же хорошо, что закон устанавливает, что стороны работают и встречаются в офисе посредника/медиатора.
Могу себе представить, какой прессинг был уготован мне в кабинете Манолаки.

Сегодня, 20 апреля 2021 г., стороны встретились на нейтральной стороне в офисе посредника/медиатора.
Как и было указано медиатором, я представил выписку из государственного регистра о моём статусе в Ассоциации Pro-Trebujeni, плюс удостоверение личности. Это означает представиться легально.

С противоположной стороны явились двое мужчин, которые не представили НИЧЕГО. Одного из них я знал ранее как Проректора USEFS по логистике (Андрей Тома). Второй был новым лицом для меня и, как он позже ответил, он не работал в USEFS ни в 2017, ни в 2018 году. По его словам, никакого знания дела у него нет и он, якобы, только сегодня узнал о том, что следует явиться к медиатору с этим вопросом. Этот второй представлялся (устно) по образованию юристом и нынешним нанятым сотрудником USEFS, даже членом его совета.

С самого начала медиатор пыталась объяснить, что нет никакого смысла вести переговоры, если одна из сторон (USEFS) не имеет легальных представительных полномочий. Тем не менее, представители USEFS настаивали на «беседе» и мы в конечно итоге потеряли из жизни более 1 часа.

Сухой остаток встречи следующий: медиатор составит протокол, который я смогу представить судье и который засвидетельствует, что со стороны ОA Pro-Trebujeni была предпринята попытка медиирования, которая, однако, провалилась. Это избавит от ненужных объяснений в суде.

Так на что же ушло более часа времени? Вы не поверите – на прессинг. Как хорошо, что он был при свидетелях. В том же офисе присутствовал ещё один юрист, вдобавок к медиатору. Он (прессинг) был довольно жёстким.
Когда, примерно на середине встречи, я всё-таки настоял «юриста» USEFS представить любой документ удостоверяющий личность, он с обидой вынул свой булетин и мы убедились в его личности.
В ответ на это он несколько раз обозвал меня «непослушным», «наглым», «необразованным», «невоспитанным» и в целом перешёл со мной на «ты» и стал чуть ли не угрожать. Всё при независимых свидетелях, наконец-то!

Не буду пересказывать всю беседу. Моя интерпретация – USEFS крайне обеспокоен возможным проигрышем этого дела в суде.

На данный момент суды закрыты на карантин до 1 мая. Новости появятся позже.

The mediation attempt of April 20, 2021

Last Friday, April 16, 2021, in the office of the Deputy Rector of the University of Sports (USEFS) Andrei Toma, we agreed that we would try to mediate the case.
USEFS insisted on meeting and talking in the office of the most important chief on earth - Rector Veaceslav Manolachi.
It is so good that the law stipulates that the parties work and meet in the office of the mediator / mediator.

Today, April 20, 2021, the parties met on the neutral site in the mediator's office.
As indicated by the mediator, I submitted an extract from the state register of my status in the “Pro-Trebujeni” Association, plus an identity card. This means introducing yourself legally.

From the opposite side, two men appeared who did not present ANYTHING. I knew one of them earlier as USEFS Deputy Rector for Logistics (Andrei Toma). The second was a new face for me and, as he later replied, he did not work for USEFS in either 2017 or 2018. According to him, he has no knowledge of the matter and, allegedly, only today learned that he should come to the mediator with this question. This second one introduced himself (orally) as lawyer by training and a current hired USEFS employee, even a member of its council.

From the very beginning, the mediator tried to explain that there is no point in negotiating if one of the parties (USEFS) does not have legal representative powers. Nevertheless, the representatives of the USEFS insisted on a "conversation" and we eventually lost more than 1 hour from our lives.

The bottom line of the meeting is as follows: the mediator will draw up a protocol that I can present to the judge and which will attest that an attempt was made to mediate by the Civil Association “Pro-Trebujeni”, which, however, failed. This will save from unnecessary explanations in court.

So what did it take over an hour? You will not believe - pressing. It's good that it was witnessed. Another lawyer was present in the same office, in addition to the mediator. This pressure was pretty tough.
When, about half through the meeting, I nevertheless insisted that USEFS "lawyer" presents any identification document, he took out his ID with resentment and we were convinced of his identity.
In response to this, he several times called me "disobedient", "arrogant", "uneducated", "ill-mannered" and, on the whole, switched to tutoyer with me and began to almost threaten me. All with independent witnesses, finally!

I will not retell the entire conversation. My interpretation is that USEFS is extremely concerned about the possible loss of this case in court.

At the moment, the courts are closed for quarantine until May 1. News will come later.

Cum am indicat deja, Rectorul USEFS a scris și a înaintat în instanță patru documente. Deja am examinat ușor două dintre ele. Iată un extras din al treilea:
“Reiese cu certitudine că Asociaţia Obştească „Pro-Trebujeni" nu poate fi proprietarul unui oarecare perete (citește de escaladă) din incinta complexului sportiv USEFS. De aici şi apare nedumerirea, cm şi în baza la ce temei, reclamantul doreşte să oblige Universitatea să încheie careva contracte asupra unui perete (citește de escaladă) care nici nu-i aparţine şi în virtutea legii, nici nu-i poate aparţine cu drept de proprietate. Mai mult ca atât, este lipsită de logică şi cerinţa reclamantului de a interzice USEFS exploatarea peretelui care este proprietate publică a statului şi a fost dat în gestiune şi folosinţă exclusivă Universităţii.”

Aceasta nu este altceva decât formularea și justificarea confiscării de către un gangster a proprietății altcuiva. În cele din urmă, a fost scris pe hârtie și semnat de rectorul USEFS Veaceslav Manolachi. Nici panoul de escaladă în ansamblu, nici vreuna dintre părțile sale componente nu au fost vreodată proprietatea USEFS, iar trimiterea la o anumită transmisie „pentru propria gestionare și utilizare” este, de asemenea, o minciună.

Vizita de astăzi la USEFS a fost determinată de apelul telefonic de ieri din partea prorectorului Andrei Toma și de invitația sa de a veni și de a-i reaminti poziția noastră cu privire la problemele fundamentale, înainte de a vizita mediatorul.

Как мы уже указали, Ректор USEFS написал и представил в суд четыре документа. Два из них мы уже слегка разобрали. Вот выдержка из третьего:
«Совершенно очевидно, что Общественная Ассоциация «Pro-Trebujeni» не может быть владельцем определенной стены (читай скалолазной стены) внутри спортивного комплекса USEFS. Отсюда возникает недоумение, как и на каких основаниях истец желает обязать Университет заключать какие-либо контракты относительно стены (читай скалолазной стены), которая не принадлежит ему и в силу закона даже не может принадлежать на правах собственности. Более того, лишено логики требование заявителя запретить USEFS эксплуатировать стену, которая является общественной собственностью государства и которая была передана Университету для его собственного управления и использования.»

Это есть не что иное, как формулировка и оправдание бандитского захвата чужой собственности. Наконец-то это написано пером на бумаге и подписано ректором USEFS Вячеславом Манолаки. Никогда ни скалодром в целом, ни какая-либо из его составных частей не был собственностью USEFS и ссылка на какую-то передачу «для собственного управления и использования» также является ложью.

Сегодня пришлось ещё раз выслушать эту позицию устно при встрече с проректором USEFS по логистике Андреем Тома и его подчинённым Константином, ответственным за спортивный комплекс. Оба, поочерёдно категорично заявили, что и речи не может идти о чьих-то бы то ни было правах собственности на скалодром. Скалодром, по их убеждению, принадлежит USEFS. Это, по их словам, есть собственность государства, ну а они послушные служители государства.

На этом пришлось с ними расстаться и повторить им, что именно поэтому нам надо встречаться либо в суде, либо у посредника.

Сегодняшний визит в USEFS была вызван вчерашним звонком проректора Андрея Тома и его приглашением прийти и напомнить ему о нашей позиции по прнинципиальным вопросам, прежде чем мы посетим посредника/медиатора.

As we have already indicated, the Rector wrote and submitted four documents to the court. We have already slightly revised two of them. Here's an excerpt from the third:
„It appears with certainty that the Civil Association "Pro-Trebujeni" cannot be the owner of a certain wall (read climbing wall) inside the USEFS sports complex. Hence the confusion, how and on what grounds the plaintiff wants to force the University to conclude some contracts on a wall (read climbing wall), which does not belong to it by virtue of the law, nor can it belong to it as a property right. Moreover, it also lacks logic the plaintiff's requirement to prohibit USEFS from operating the wall which is a public property of the state and was given in management and exclusive use by the University.”

This is nothing more than the formulation and justification of the gangster's seizure of someone else's property. Finally, it was written in pen on paper and signed by the rector of USEFS Veacheslav Manolachi. Neither the climbing wall as a whole, nor any of its component parts, has never been the property of USEFS, and the reference to some transmission "for its own management and use" is also a lie.

Today I had to once again listen to this position expressed orally when meeting with USEFS Deputy Rector for Logistics Andrei Toma and his subordinate Constantin, who is responsible for the sports complex. Both, in turn, categorically stated that there could be no question of anyone's property rights to the climbing wall. The climbing wall, in their opinion, belongs to the USEFS. This, according to them, is the property of the state, and they are obedient servants of the state.

At this we had to part with them and I repeated that this is exactly why we need to meet either in court or at the Mediator.

Today's visit to USEFS was prompted by yesterday's call from Deputy Rector Andrei Toma and his invitation to come and remind him of our position on fundamental issues before we visit the mediator.

Astăzi, pentru prima dată în mai bine de 2 ani, prorectorul Universității de Sport a sunat să felicite cu ocazia sărbătorilor de Paște și, în același timp, să răspundă invitației mele scrise din 4 martie de a implica serviciile unui Mediator și a ajunge la un acord înainte de următoarea ședință de judecată. Exact cm a propus judecătorul.
A trebuit să explic din nou această procedură prin telefon, pentru care mai rămân doar 4 zile, inclusiv 2 zile libere.

Însuși invitația de a ajunge la un acord a fost primită de Universitate pe 10 martie (atașat un scan).

Cred că nu a fost o lună de reflecție care i-a determinat să reacționeze. Cu doar 7 zile în urmă, am depus încă câteva documente în instanță care resping o minciună directă scrisă pe hârtie și semnată de rector.

Сегодня, впервые за 2 с лишним года, позвонил проректор Университета Спорта поздравить с пасхальными праздниками, ну и заодно среагировать на моё письменное приглашение от 4 марта вовлечь услуги посредника (Mediator) и достичь согласия до следующего судебного заседания. Ровно, как и предложил судья.
Пришлось ещё раз растолковать по телефону эту процедуру, для которой осталось всего 4 дня, включая 2 выходных.

Само приглашение достичь соглашение было получено Университетом ещё 10 марта (прилагается скан).

Думаю, вовсе не месяц раздумий побудил их среагировать. Просто 7 дней назад мы подали в суд ещё несколько документов, которые опровергают откровенную ложь, написанную на бумаге и подписанную ректором.

Today, for the first time in more than 2 years, the deputy rector of the University of Sports called to congratulate on Easter holidays, and at the same time to respond to my written invitation of March 4 to involve the services of a Mediator and reach an agreement before the next court hearing. Exactly as the judge suggested.
I had to explain this procedure over the phone again, for which there were only 4 days left, including 2 days off.

The very invitation to reach an agreement was received by the University on March 10 (scan attached).

I think it was not a month of reflection that prompted them to react. Just 7 days ago, we filed a few more documents in court that refute an outright lie written on paper and signed by the rector.

Al doilea document interesant, primit de instanță și semnat de rectorul USEFS este Cererea privind atragerea în proces în calitate de intervenient accesoriu pe donatorul străin - PNUD.
Faceți cunoștință cu declarația de motivație:
“Din materialele prezentate de către reclamant la cererea de chemare în judecată şi din argumentele aduse de acesta, reiese cu certitudine că o eventuală hotărâre adoptată pe cauza dată va influenţa drepturile şi/sau obligaţiile unei persoane terţe care nu este parte la proces şi anume a Programul Naţiunilor Unite pentru Dezvoltare (PNUD). La fel, reclamantul în contractul de execuţie şi contractul de folosinţă anexat la cerere, face trimitere la Acordul de Grant nr.80868 încheiat între Asociaţia Obştească „Pro-Trebujeni" şi Programul Naţiunilor Unite pentru Dezvoltare (PNUD), însă din Acordul de Grant nr.80868 prezentat în limba engleză, nu se înţelege care este legătura Universităţi de Stat pentru Educaţie Fizică şi Sport a Republicii Moldova cu acesta şi cu situaţia descrisă.
Prin urmare, pentru a interpreta probele prezentate de către reclamant şi de a clarifica situaţia creată, considerăm că este oportun şi necesar de a atrage în proces în calitate de intervenient accesoriu Programul Naţiunilor Unite pentru Dezvoltare (PNUD).”

Traducere într-un limbaj simplu: „Cer instanței să afle ce au făcut aceste două organizații în complexul sportiv al unei universități de stat timp de 2,5 ani? Cum îndrăznesc așa ceva?"

Вторым интересным документом, поступившим в адрес суда и подписанным ректором Университета спорта, является Заявление об обязательном приглашении участвовать в судебном разбирательстве иностранного донора – ПРООН.
Зацените формулировку:
«Из материалов, представленных заявителем к заявлению, и из выдвинутых им аргументов ясно, что любое решение, принятое по настоящему делу, повлияет на права и/или обязанности третьей стороны, которая не является стороной в разбирательстве, а именно Программа развития ООН (ПРООН). Аналогичным образом, заявитель в контракте об исполнении работ и контракте на использование, приложенном к заявке, ссылается на Соглашение о гранте № 80868, заключённое между Общественным объединением «Pro-Trebujeni» и Программой развития Организации Объединенных Наций (ПРООН), однако Соглашение о гранте № .80868 представлено на английском языке и непонятно, как связаны с ним и описанной ситуацией Государственный университет физического воспитания и спорта Республики Молдова.
Поэтому, чтобы интерпретировать доказательства, представленные заявителем, и прояснить ситуацию, мы считаем целесообразным и необходимым привлечь Программу развития Организации Объединенных Наций (ПРООН) в качестве соучастника, вмешивающегося в этот процесс".

Перевод на простой язык: «Прошу суд разобраться, что у нас в спорткомплексе государственного вуза делали в течение 2,5 лет эти две организации? Как они посмели?»

The second interesting document received by the court and signed by the rector of the University of Sports is the Statement of mandatory invitation to participate in the trial of a foreign donor - UNDP.

"It is clear from the material submitted by the applicant to the summons and from his arguments that a judgment given in the present case will influence the rights and / or obligations of a third party who is not a party to the proceedings, namely United Nations Development Program (UNDP). Likewise, the applicant in the contract of ex*****on and the contract of use annexed to the application, makes reference to the Grant Agreement no.80868 concluded between the Civil Association "Pro-Trebujeni" and the United Nations Development Program (UNDP), but from the Grant Agreement no.80868 presented in English, it is not clear what is the connection with it and with the described situation of the State University for Physical Education and Sports of the Republic of Moldova.
Therefore, in order to interpret the evidence presented by the complainant and to clarify the situation, we consider it appropriate and necessary to bring the United Nations Development Program (UNDP) as an ancillary intervener in the process. "

Translation into simple language: “I ask the court to find out what these two organizations have been doing in the sports complex of a state university for 2.5 years? How did they dare?"
