Today, ahead of independence day celebrations ๐พ ๐ in Kwame Nkrumah's Ghana ๐ฌ๐ญ , we have gathered some basic court terms & procedures for our fans.
IN A COURT OF LAW IN GHANA ๐ฌ๐ญ
โกPleaded not guilty: suspect has told the court he/she did nothing wrong & therefore not guilty of the offense/charge.
โก[Note]: a guilty plea or pleaded guilty is just the direct opposite of the above statement.
โกPeople plead guilty to avoid trials in court when they are willfully & knowingly aware that they are guilty of the charge/offense.
โก/NB/: Advantage of a guilty plea is to avoid trials & subsequent receive a minimum or lower sentence.
[ /NB/: the judge also has the power to accept or reject your guilty plea based on other circumstances in connection with the case].
Example is when you are being influenced or forced by a prosecutor or law enforcer to accept a guilty plea.
โกNot pleading guilty ? [no guilty plea?]
Well, if found guilty during the trials you may face a higher or maximum sentence in most cases.
โ Police Bail:
Happens at the police station immediately following arrest or during an investigation (before the charge). It is generally free, but violations of bail conditions such as failure to show up to the police station at scheduled times can lead to re-arrest.
โ Court Bail:
Happens after a person has been charged and appears before a judge or magistrate. It is regulated by specific laws and often involves stricter conditions, such as a suretie[s] [house or other landed property or financial [money].
โ All these above bail conditions are not demanded by the court until the suspect is no where to be seen or found over a period of time & the court will then proceed to seize these property from the sureties.
