Fight That Parking Ticket

Fight That Parking Ticket Fighting parking tickets on your own behalf.

* _ IMPORTANT _ *

Before I relate MY recent experience I'd like to ask the good people out there what results they may have had asking for the same thing.

Specifically, did you ever get a parking ticket then call or email APS to have the photos that the officer took at the time the ticket was printed to be emailed or sent to you?

If so, what were you told? With what results?

Now please keep in mind I only need you to respond IF you've actually tried this and not what you THINK might happen or what you HEARD your brother's friend's uncle said.

In my case, the APS agent on the phone tried to tell me that they NEVER send the photos out. That I was NOT entitled to them.
That if I wanted to see them I had to physically travel to one of the seven parking ticket counters around the city with the ticket
and ask the clerk to bring up the photos on the screen and turn the screen so I could see them.
There may also have been some mention that I would have to pay for each printout. She wasn't sure.
It was only after I strenuously objected that she consulted with a manager and was told to email the manager who would process my request. This was done and I have the photos in PDF format.

Given how I was told at first that I was not entitled to them at all I started to question the legality of this policy.
Google "Exculpatory Evidence Canada" to see why.

If there are any lawyers or paralegals reading this that would like to weigh in on this topic it would be most welcome. If you'd like to remain anonymous message me directly and I can copy & paste your comments.

Hope this helps clear some things up.

In Toronto, the LEGAL definitions of parked, stopped & standing are:

No Parking
. . Drivers can stop to pick up or drop off passengers or to load or unload goods, but cannot leave the vehicle unattended.

No Standing
. . Drivers can only stop to pick up or drop off passengers.
They cannot load or unload goods.

No Stopping
. . Drivers can only stop to avoid conflict with other traffic or to comply with a traffic control sign, police officer, or constable.
They cannot stop for any other reason.

Getting towed can be very expensive in Toronto.
I myself got towed the other day and so far it cost $340 which doesn't even include the parking ticket itself so maybe add ANOTHER $190 !
So maybe as much as $530 plus the cab ride.

It's not good enough to just look for signs close to the car.
Sometimes you have to check the whole block.

I JUST saw a guy get a $50 ticket for "Park More Than 60 Minutes" -- from 2:14 to 3:15.
Yup. One fu***ng minute over.

When requesting a parking ticket review, currently the screening decision takes well over a YEAR.

Some fairly new things that Toronto drivers absolutely need to be made aware of.
Dated from August, 2022 and taken directly from the city's own files.

To summarize:
- You cannot have a FOR SALE sign on your car if it is parked on the street.
- You cannot wash your car on the street.
- You cannot park within 15 meters of a Canada Post mailbox. That's just over 49 feet.

And I know this last one is being enforced because someone asked me for help on it.
I thought for sure she had misread the ticket.

She got a $40 ticket a year ago.
No doubt it's at least $60 now since the Aug. 1 increases.
Meanwhile, you cannot park within THREE meters of a fire hydrant.
Are Canada Post trucks bigger than fire trucks?
Do they need that much more space for the job?

Also note Section E begins:
. . "Where authorized signs to that effect are displayed..."

Has anyone ever seen a sign near a mailbox warning drivers not to park there?

If there are any lawyers reading this that feel outraged over this we could use some help.
Some of this is pure money grab. Taxation without representation.

(Editor's Note: I changed some words to all caps for emphasis.)

TORONTO MUNICIPAL CODE
CHAPTER 950, TRAFFIC AND PARKING

(7) For the purpose of WASHING, greasing or repairing the vehicle, except for such repairs as have been necessitated by an emergency.

E. Where authorized signs to that effect are displayed, NO PERSON SHALL on any highway PARK any vehicle:
( 8 ) Within a turning basin; (What the hell is a turning BASIN? Not defined in the code.)
(13) Within a distance of up to 15.0 meters of any Canada Post MAILBOX on the side of the highway on which the mailbox is located.

HEADLINE:
. . "Man, officer taken to hospital after parking dispute: police"

This is EXACTLY the kind of thing I've been talking about.

A guy stopped possibly to p/u his kid with at least part of his car ALLEGEDLY on a bike path or lane.
There may not have been anywhere else to legally park. He may have left the engine running.
He might have just gone up to the front door to let them know he was there waiting and went back to his car to wait.
We don't know and the cops are certainly spinning this for all its worth to make themselves look like poor, little victims.
They made sure all of Toronto knows that one of their cops "went to the hospital".
He probably just bruised his knuckles punching the guy.
We just don't know and Toronto's Secret Police will never tell us the details of what actually happened. Not ever.

Anyway, the guy comes back to see the Blue Hornet slapping a $200 ticket on his car.
No trial. No defense. YOU'RE GUILTY ! PAY UP !
The guy loses it and starts yelling so the PEO calls for back-up infuriating the citizen even more.
Cops arrive and things apparently get physical and he's arrested.

Skip ahead a bit and Toronto Police Services spokes person Det.-Sgt. Jeff Bassingthwaite said in part . . .
. . "This is another incident where our members (cops) were assaulted because people are becoming violent over a parking ticket,"

100% pure, unmitigated BU****IT.

People are not by and large becoming more violent.
You can't blame the public for this. They are not the cause here.

Oh, and BTW, by a complete coincidence the fines for 123 various parking tickets increased just a few days ago on August 1. A lot.

So yeah, when the TAX COLLECTOR comes round and says "The amount you paid last year wasn't enough for us. We want more."
Then he puts one of those yellow tax bills on your car with incredible efficiency and sprints to the next car.

When we can't find permanent, full time jobs and when pay hasn't gone up but the price of gas, rent, insurance, transit, FOOD all go up and then you want to squeeze our balls just a bunch more then guess what.
People ARE going to fight back. With great anger and in ever increasing numbers.

But don't you DARE say the public is getting more violent.
And don't you dare say you're shocked that this is happening on a greater & greater regular basis.
This has happened before. Things could get way more violent. Heads may roll. Again.
