AEROHYDROTECH Design [AHTDI] via WAVE—NZL—INTL Ltd. has commenced legal proceedings in Canada, Australia, New Zealand, Italy and the European Union to defend its intellectual property rights.
In 2020, we were commissioned to deliver original design solutions for a watersports start-up brand and parent company project. Those designs were delivered in full as per confirmed briefs. They were accepted then produced and commercialized globally without full payment, license, and without IP release.
That constitutes multiple intellectual property infringements.
For six years, we sought resolution. We documented every communication, every sketch, 2D drawing, 3D model, simulation, rendering, images, and document produced and provided to the founding partners and subsequently to their partners and associates. We gave every opportunity for payment of the due balance.
No resolution was ever achieved, the matter is before the courts in three jurisdictions.
This is not about one project or one company. It is about a principle: Designers must be paid in full for their work. Original creative work has value. When that value is taken without compensation, the law provides remedies to address the matter and obtain compensation for losses and damages. We are pursuing all of them.
The watersports industry runs on innovation and a common ethical code. We all belong to a community that values respect and honesty. Innovation runs on respect — for ideas, for concepts, for creators, for users. The companies and brands that form this ecosystem cannot function when that respect is absent.
AEROHYDROTECH Design will continue to innovate, define, design, develop, and deploy creative concepts for product lifecycle ecosystems worldwide — and will fiercely protect what we create.
No further comment will be made while legal proceedings are active.
