AGFC Rants: Deer Season Kickoff & Private Property Policy

Deer season starts tomorrow, and while we're all gearing up to get in the woods, it’s time for a critical refresher on your rights as a hunter—specifically regarding AGFC enforcement on private property.

Some game wardens do a solid job and respect landowners, but plenty of them act like they can roam wherever they want, whenever they want, regardless of the rules.

AGFC’s Private Property Policy sets strict boundaries on what officers can and cannot do on private land.

Key Highlights Every Private-Land Hunter Must Know

* No Random Compliance Checks on Private Land: Under AGFC policy, Game Wardens are explicitly barred from running routine compliance checks (demanding your license, tag, or gear) while you are actively hunting on private property unless they have probable cause of an actual violation.

* Strict Entry Requirements: To step foot on private property, an officer must have one of seven legal grounds:

* A valid search warrant

* An articulable reason

* Explicit permission or request from the property owner, lessee, or occupant

* Probable cause of a crime/violation

* Exigent/emergency circumstances (imminent danger to life)
* Active search and rescue operations

* A fleeing suspect who ignored a lawful order to stop

* Entry Logging: Officers are required to keep a log documenting every instance they enter private land, along with their specific legal reason for doing so.

* Public vs. Private Rules: On public lands or public waters, wardens still have broad authority to run routine compliance checks without prior suspicion. On private ground, the standard is completely different.

How to Handle an Encounter on Private Land
If an officer approaches you on private property without a warrant or explicit landowner permission:

* Stay Calm and Polite: Never resist physically or escalate the situation.

* Ask the Critical Question: Politely ask, "Officer, what is your probable cause or articulable reason for entering this private property today?"

* Know the Limit: You have the right to point out that under AGFC policy, routine compliance checks on private land are not authorized without probable cause or landowner consent.

Knowledge is power. Keep this policy in mind, respect private property rights, hunt safe, and let’s put some bucks on the ground this season!

When it comes to managing our state's wildlife, fisheries, and public lands, two key positions hold the reins: the AGFC Commissioners (who set policy, regulations, and budgets) and the AGFC Director (who runs day-to-day operations).

❓ What qualifications do you think a Governor should require before appointing an AGFC Commissioner? Is background in business, law, or farming enough, or should a formal degree/career in wildlife biology or natural resources be mandatory?

❓ What about the Director? Should the person leading the agency be required to have hands-on, professional experience in fish and wildlife management, or is executive management experience all that matters?

AGFC RANTS:
Who actually wants to pack up their gear, drive out to public land on a weekend, and do unpaid manual labor for a state agency? 🪵🪓

AGFC put out another post looking for volunteers to come do heavy lifting on public grounds.

Let’s get one thing completely straight: Arkansans are already paying sales taxes, license fees, habitat stamps, and permit costs that are supposed to fund the maintenance and management of our outdoor resources.

So where is all that extra revenue actually going?

Because if the budget is somehow big enough to keep creating cushy upper-management roles, executive titles, and administrative bloat in Little Rock, it should be big enough to hire actual, paid field crews to maintain our lands.

Expecting everyday, working-class folks to donate their free time to do the agency's job for them is a wild expectation.

Before AGFC asks the public to roll up their sleeves and provide free labor, maybe it’s time they trim the fat at the top, evaluate their administrative overhead, and put our hard-earned money back into boots-on-the-ground operations.

​Several followers have reached out to us asking about where these funds are actually going—specifically questioning how much of this money is slated to be spent on or around large, high-profile duck lodges or private properties tied to AGFC affiliates and board members.
